TERMS OF USE

1. ABOUT THESE TERMS

These Terms of Use are an agreement between you and Gourmetmiles Inc., a Delaware corporation based in Austin, Texas ("Gourmetmiles," "we," "us"). They cover the Gourmetmiles app, the Gourmetmiles website, and our related services (together, the "Services").

By creating an account or using the Services, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the Services.

2. WHO CAN USE THE SERVICES

You must be at least 18 years old to use the Services.

3. THE APP IS FREE

The Gourmetmiles app is free to use.

We previously offered a paid upgrade called Gourmetmiles Plus. It has been discontinued, and any purchase you made was handled by Apple or Google under their own terms. If you have a question about a past charge, email support@gourmetmiles.com.

4. YOUR ACCOUNT

You are responsible for keeping your password private and for activity on your account. Please use a password you do not use anywhere else.

If you think someone else has used your account, tell us right away at support@gourmetmiles.com.

You can delete your account at any time in the app, under Settings.

5. NUTRITION, ALLERGEN AND HEALTH INFORMATION

The Services help you record and understand what you eat. They do not provide medical advice, diagnosis or treatment, and they do not replace a doctor, dietitian or other qualified professional. Talk to one before making changes to your diet for a health condition, pregnancy, breastfeeding or any other medical reason.

Nutrition, ingredient and allergen information comes from third-party databases, restaurants, manufacturers, and what you enter yourself. It can be incomplete, out of date or wrong.

When the app shows an allergen or an ingredient as "not checked," it means the information is not available. It never means the food is safe.

How the alerts work. The app warns you by matching the ingredient and product names on a food against a list of names we keep for each allergy you have chosen. A food can therefore contain something you react to and raise no warning — because it is named in a way our list does not cover, because the ingredient information we have is incomplete, or because we have changed the lists. We add to and correct these lists over time, and they can change without an app update.

What the alerts cover. You can choose warnings for the nine allergens that must be declared on food labels in the United States — milk, eggs, fish, shellfish, tree nuts, peanuts, wheat, soybeans and sesame — and for gluten. Wheat and gluten are not the same: a wheat warning does not cover barley, rye, malt or the other gluten grains, so if you avoid gluten, choose the gluten warning as well. You only get warnings for the allergies selected in your profile. Choosing a diet group, including Celiac, does not by itself add a warning, so when we add a new warning, check your allergies in Edit Profile.

Food you edit or add yourself. You can change a food's details or add a food of your own, by hand or from a photo. When you do, your allergy and ingredient warnings for that food run against what you entered, not against our original information. If what you entered is incomplete or wrong, the warning will be too. Anything you have changed is marked "Edited by you," and you can restore our original at any time. If you have a food allergy, check your own edits as carefully as you would check a label.

If you have a food allergy or a medical dietary need, always confirm ingredients and allergens with the food's maker, seller or restaurant before eating it. Never rely on the Services alone where a mistake could cause illness or injury.

Weights from the Macroscale and amounts you type in are only as accurate as the scale, how it is used, and the food data they are matched to.

6. HELP ANSWERS WRITTEN BY AI

The Help screen uses artificial intelligence provided by Anthropic to answer questions about the app and the Macroscale, based on our own written guide. It works only after you give permission on the Help screen.

AI answers are generated automatically. They can be wrong or incomplete, and they are not medical, nutrition or allergy advice. If an answer does not solve your problem, use "Send to the Gourmetmiles team" to reach a person.

Please do not use the Help feature for anything other than questions about Gourmetmiles and the Macroscale. If an answer is ever offensive or inappropriate, please report it to us with "Send to the Gourmetmiles team" or at support@gourmetmiles.com.

How your questions are handled is explained in our Privacy Policy.

AI SmartScan identifies food from a photo you take. What it returns are suggestions: you choose which one is right, and you can change or correct it before you log it. Nutrition figures come from the USDA food database, not from the AI. Like any AI, it can be wrong. The rules in section 5 about allergens and ingredients apply to anything you log this way.

Coach answers questions about your own diet, water and nutrient goals, and can suggest a week of meals, using the information described in our Privacy Policy. It works only after you give permission on the Coach screen. Anything Coach suggests is a suggestion for you to review, change or reject — not a plan you are being told to follow. Coach is not medical, nutrition or allergy advice, it does not diagnose or treat any condition, and it does not replace a doctor or dietitian. Like any AI it can be wrong, including about ingredients and allergens. Talk to a qualified professional before changing your diet for a health condition, pregnancy, breastfeeding or any other medical reason. The rules in section 5 apply to anything Coach suggests, including meals it suggests for you.

7. THE MACROSCALE

The Macroscale is sold separately. Purchases made on Amazon are governed by Amazon's terms of sale.

Use the scale as described in its operating instructions. Any warranty for the Macroscale is described in its product documentation.

The app is designed to work fully without the Macroscale.

8. APPLE HEALTH AND HEALTH CONNECT

If you turn on Apple Health or Health Connect, the app writes the meals you log, and the water and weight you type in, to it. With your permission it also reads certain health and activity types to show them in My Health. What it reads stays on your phone. You control all of this in the app and in Apple Health's or Health Connect's own settings.

9. ACCEPTABLE USE

Please do not:

  • break the law while using the Services;
  • try to reach accounts, systems or data that are not yours;
  • interfere with the Services or place an unreasonable load on them;
  • copy, scrape or resell the Services or the data in them;
  • reverse engineer the app, except where the law allows it;
  • try to make the Help feature do things other than answer questions about the app; or
  • use the Services to harass or harm anyone.

We may suspend or close accounts that do.

10. YOUR INFORMATION AND YOUR FEEDBACK

What you log and enter stays yours. You give us permission to store and process it only as needed to provide the Services, and as described in our Privacy Policy.

If you send us ideas or suggestions about the Services, we may use them without owing you anything.

Food details you share with us. When you add or edit a food, a copy comes to us. We may use it to improve the food information we show to everyone, including by adding it to our own food data. For that purpose you give us a non-exclusive, worldwide, royalty-free, perpetual licence to use, copy, adapt and publish what you submitted — the food's name, its details, and any photo you added — with no obligation to credit you. You keep ownership of it, and we never publish your name, your photo or anything identifying you alongside it.

You confirm that anything you submit is yours to submit — in particular, that any photo is one you took or have permission to use, and that it does not show a person.

11. OUR APP AND CONTENT

The app, its design, software and content, and the Gourmetmiles and Macroscale names and logos, belong to Gourmetmiles or its licensors.

We give you a personal, non-transferable, revocable license to install and use the app on devices you own or control, for your own non-commercial use, subject to these terms.

12. APPLE AND GOOGLE

If you downloaded the app from Apple's App Store or from Google Play:

These terms are between you and Gourmetmiles, not Apple or Google. Gourmetmiles, and not Apple or Google, is responsible for the app, for its maintenance and support, and for any claim relating to it, including product liability claims, claims that it fails to meet a legal or regulatory requirement, and claims under consumer protection or intellectual property law.

If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the price you paid for the app, if any. Apple has no other warranty obligation for the app.

You confirm that you are not located in a country subject to a U.S. government embargo, and that you are not on any U.S. government list of prohibited or restricted parties.

You must also follow the app store's own terms of service.

Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. OTHER COMPANIES' SERVICES

The Services rely on services and data provided by other companies, including food databases, Apple and Google sign-in, Apple Health, and Anthropic. Their own terms and privacy policies apply to what they do, and we are not responsible for them.

Links to other websites are provided for convenience only.

14. CHANGES, SUSPENSION AND ENDING

We may change, pause or stop any part of the Services.

We may update these terms. If a change is significant, we will tell you in the app before it takes effect. Continuing to use the Services after that means you accept the updated terms.

You may stop using the Services and delete your account at any time.

We may suspend or close your account if you break these terms, or if we need to in order to protect the Services, other users, or to comply with the law.

15. DISCLAIMERS

The Services are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We work to keep the Services secure and available, but we cannot promise that they will be uninterrupted, error-free, or free from unauthorized access.

Some places do not allow these disclaimers, so some of them may not apply to you.

16. LIMIT ON LIABILITY

To the fullest extent the law allows, Gourmetmiles will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data or lost profits, arising from the Services.

Our total liability for any claim relating to the Services is limited to the greater of the amount you paid us for the Services in the 12 months before the claim, or US $100.

These limits do not apply where the law does not allow them, including for our gross negligence, willful misconduct or fraud.

17. IF YOU BREAK THESE TERMS

You agree to cover reasonable losses and legal costs we incur because of your misuse of the Services or your breach of these terms.

18. DISPUTES

Texas law governs these terms, without regard to its conflict-of-law rules.

Informal resolution first. Before filing any claim, please email support@gourmetmiles.com and give us 30 days to try to resolve it with you directly.

Arbitration. If we cannot resolve it, any dispute relating to the Services will be resolved by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration fees are paid as those rules provide. An arbitrator can award the same individual relief a court could.

Exceptions. Either of us may bring an individual claim in small claims court, and either of us may ask a court to stop infringement or misuse of intellectual property.

No class actions. Claims may be brought only individually, and not as a plaintiff or class member in any class or representative action.

How to opt out. You may opt out of this arbitration section by emailing support@gourmetmiles.com within 30 days of first accepting these terms, with your name, your account email address, and a statement that you are opting out. Opting out does not affect the rest of these terms.

Court. Any dispute that is not arbitrated will be heard in the state or federal courts located in Travis County, Texas, and both of us consent to the jurisdiction of those courts.

19. GENERAL

These terms and the Privacy Policy are the entire agreement between you and us about the Services.

If part of these terms cannot be enforced, the rest still applies. Our not enforcing a term is not a waiver of it.

You may not transfer these terms to anyone else. We may transfer them as part of a merger, acquisition, or sale of assets.
